CMS / AHRQ Report : Study of Paid Feeding Assistant Programs (3/30/07) Posted: Oct. 9, 2007 This report, conducted by Abt Associates on behalf of the Centers for Medicare and Medicaid Services (CMS) and the Agency for Health Care Quality and Research (AHRQ) responds to concerns about the impact of allowing use of paid feeding assistants (PFAs) on the care and safety of nursing home residents. The report includes a Survey and Certification Memo announcing publication; the Findings, Conclusions, and Recommendations; and the Full Report with Appendices I - IX.
Grants Available for Workforce Development

To increase the long-term care workforce, the Department of Labor is making grants available for five demonstration projects to address job training and workforce development in our field. Applications are due by April 5 and should explain how the applicant will partner with business and education representatives on a regional basis. A webinar on the program will be held on March 5.
Final Rule on Posting Staffing Levels in Nursing Facilities

The Centers for Medicare and Medicaid Services (CMS) issued a final rule for nursing facilities to post individual shift data and the total hours worked each day by licensed and unlicensed nursing staff. The requirement, legislated by Congress in 2000, has been in effect since January 1, 2003, but CMS has taken longer to specify reporting guidelines. The final rule was published in the Federal Register on Oct. 31, 2005, and will take effect Dec. 27, 2005.
Federal Court Upholds Feeding Assistant Regulation

The court’s ruling allows continued implementation of the CMS rule allowing specially-trained staff to assist nursing home residents with eating and drinking.
Administrator Held to Higher Standard of Conduct than Staff Nurse
An Ohio appeals court has ruled that a nursing home administrator can be held to a higher standard of conduct, based on his position of authority, than a staff nurse who does not have a supervisory role. The court concluded that a nursing facility company did not violate state law or public policy when it demoted a facility administrator after it was discovered that the administrator and a non-supervisory female employee had developed a romantic relationship in violation of the company’s no-fraternization policy.
Worker with Joint Employers Eligible for Overtime Pay
The U.S. Supreme Court has rejected a petition to overturn a federal appeals court decision which held that the overtime provisions of
the Fair Labor Standards Act (FLSA) required payment of overtime for healthcare employees who worked more than 40 hours per week for separate but related employers. The high court left standing the ruling by the U.S. Court of Appeals for the Ninth Circuit on the basis that the companies were "joint employers."
NLRB Reverses Itself; Holds Weingarten No Longer Applies To Non-Union Employees
In a June 9 decision, the National Labor Relations Board (NLRB) reversed a prior decision and held that, unlike union employees, non-union employees are not entitled to have a representative present in an investigatory interview that could lead to disciplinary action. The Board concluded that, in the absence of a union relationship, the right of an employee to a co-worker’s presence is outweighed by the employer’s right to conduct a thorough, efficient and confidential investigation.
Department of Labor Announces Final Overtime Regulations
The U.S. Dept. of Labor (DOL) announced April 20 the release of final regulations governing exemptions from the overtime requirements
of the federal Fair Labor Standards Act (FLSA). Hailed by Secretary of Labor Elaine Chao as a "win" for workers, the final regulations, published in the April 23 edition of the Federal Register, differ significantly from proposed regulations issued by the DOL in July, 2003 and guarantee overtime for a wider range of employees.
