Hurricanes Katrina and Rita devastated the Gulf Coast. The hurricanes destroyed thousands of homes in Mississippi, Alabama, Louisiana, and Texas, leaving thousands without a place to live. In the weeks since, the Department has received inquiries from certain housing providers asking whether they may house evacuees under the age of 55 from that region and continue to qualify for the Fair Housing Act's "housing for older persons" exemption.

Title VII of the Civil Rights Act of 1968 (the Federal Fair Housing Act), as amended by the Fair Housing Amendments Act of 1988 (the Fair Housing Act), prohibits discrimination in housing and real estate-related transactions based on race, color, religiion, sex, national orignin, handicap and familial status. The prohibition against discrimination based on familial status became effective March 12, 1989. The Act contained a provision exempting "senior" housing from the prohibition against familial status discrimination.
